Perseverance IT Solutions Pvt. Ltd. (owner of the website http://itrafficcop.in, which is hereinafter referred as “the website”) along with its directors, subsidiaries, affiliates, officers, employees, agents, partners, licensors and designees (collectively referred to as "the Parties") are providing, by means of the website, a platform for the uploading of Content by third parties in the capacity of internet intermediaries. Content means and includes any information, data, text, software, music, sound, photographs, graphics, video, audio-video, messages, or other materials that is uploaded, posted, transmitted or otherwise made available on the website. The Parties are not the owners of the Content nor do they exercise any control over the Content. The Content is user generated which is offered by third parties and provided on an "as is" basis. The owner of the Content has granted the Parties an irrevocable, perpetual, worldwide, royalty-free right and license to use, publicly display, publish, reproduce, distribute and broadcast the Content on any medium while at the same time indemnifying them against violations of any law for the time being in force. You subscribe to use of the Content at your sole risk.

The Parties make no representations, warranties or guarantees whatsoever for inter alia, the quality, reliability, authenticity, accuracy, originality and completeness of such Content and will not be responsible or liable in any manner for any errors, omissions, mistakes or inaccuracies in the Content or for any loss or damage of any kind incurred by the acquisition and use of the Content or in respect of any interruption or cessation of transmission to or from the website, or for the infringement of any third party rights or any other violation of any law for the time being in force by the owner of the Content or by the nature of the Content. The owner has contractually indemnified the Parties against all of the above and is to be contacted directly in the event of any dispute or complaints.

The Parties shall have the right (but not the obligation) in their sole discretion to delete or remove any Content that is infringing/defamatory/threatens to incite violence/ is objectionable or in any other manner violates the law of the land (hereinafter, “objectionable content”) at their sole discretion upon receipt of an appropriate notice from a third party enclosing evidence of such objectionable content. All such notices insofar as they pertain to infringing content must be issued by the statutory or common law owner of the underlying rights along with proof of right and those pertaining to an allegation of defamation must be issued by the person claiming defamation with an order of a court directing such takedown. The taking down of any content pursuant to the receipt of a take-down notice (as defined and understood under the Information Technology Act, 2000) will follow the procedure prescribed in the statute and the rules, as applicable to intermediaries.
